Why we need a change: Under the current council this is what has gone on behind your back. While you work to pay bills, longer and harder hours, they are setting policies that will eat into your pocket book more. Lets explore what they have said either directly, or through a vote and allowing others to speak on behalf of Middleton.
City Sewer – the debt brought onto the city violates Idaho Constitution Section 3 – Idaho State Legislaturehttps://legislature.idaho.gov/statutesrules/idconst/ArtVIII/Sect3/ It “squarely places the debt of future expansion on the current sewer users of Middleton”
Roberta under oath at the County AOI Meeting : School ordinance “promise to revoke” Is this a town that will be strong armed by an unelected administrator? Why would our city council allow this?
Our city council voted to send both these statements forward. Does the end justify the means & what else are they willing to lie about?? (4 min view)

SCHOOLS: City of Middleton failed its citizens by rejecting 🏫 Idaho Code § 67-6508(e) – Planning Duties : This section required cities and counties to consider: “The needs of schools in the planning process, including consideration of school capacities, transportation plans, and the location of future school sites.” cities and counties to consider: Many schools are over capacity, busses are over capacity and both of these statements were accurate since 2022. David Murray did not use the existing ordinance to say no,in my opinion, I believe he waited until the sewer capacity was full and the moratorium on new applications was put in place, and used the school ordinance to gain political stance. Had he cared about our children he would not have voted NO on the mayor using her own money to provide for a fence at Tank park to protect the children from Highway 44 traffic and he would have voted NO on 23 of the 24 subdivision annexation and/or developments which have increased our school capacity beyond their means using existing Idaho code.
SEWER: City of Middleton despite evidence of failing effluent in our water way and epa information for our sewer systems , council continued to approve 23 out of 24 new subdivisions, which included annexation of county farmland while not fixing the problem with effluent discharge first, then is making a fix tied to the backs of the citizens.

The Surplus is based on estimated population from Table 2-1 Growth chart, determining adequate
H20 through 2040, but recognizing deficit in Zone 3

The population however shown in the population chart has already surpassed the estimated 2019
growth curve. To better view the deficits in our wells, we need to adjust the dates to be equivalent
with the actual population NOT THE [projected population ] DATE OF 2041.
We have a water problem source problem that no developer can fix.

City of Middleton Judical Review and what was missing:
Judicial review requires a meaningful public hearing. What we got were material omissions from our public hearing. Honorable Judge Whiting in the 3rd Circuit ruled based on the material provided by the city which omitted scope of the plan. We did not know the scope of the plan, and this caused a $78 Million dollar liability on the current system users.
Judicial hearing – Oct 1, Honorable Judge Whiting Statements in testimony provided by the city, voted to approve to go to judicial hearing by City Council:
- 2:37 “this is ordinary and necessary”
- 2:45 It is not for excess capacity or future capacity
- 2:52 It will serve current citizens
- 5:00 Repayment at $3.5M per year revenue bond — current users will pay.
Canyon County AOI hearing –
Oct 16 It was confirmed that the intent of this $78M judicial review to bring indebtedness was for future growth:
- Upgrade planned: a new discharge permit, getting $89M funding to start new plant. Area of Impact.
- Tied to subdivision approval (18:30–19:15)
- It (the sewer) will keep up with us (growth of the city).
- Once funded city council will begin entitling more subdivisions
- If we get this money we will quickly quickly reach our area of Impact (22:40)
- The intent of the $78M was to get approval for money to fulfill the Idaho Code § 67-6526 4b City of Middleton.
- Once funded the city will entitle new subdivisions.
